Legal Structure
Lee Memorial Health System
(LMHS) is a public health care system created by special act of
the Florida Legislature, Ch. 2000-439, Laws of Florida, Special
Acts, 2000.
Formerly known as Hospital
Board of Directors of Lee County, LMHS is a special purpose unit
of local government. It is classified as an independent special
district under the laws of Florida. The original Enabling Act
(Chapter 63-1552, Laws of Florida, Special Act, 1963) was
enacted in 1963 and amended several times since 1963. Chapter
2000-439 constitutes a codification required by Florida Law and
is the current Enabling Act.
The Lee Memorial Health
System Board of Directors is the governing board and operates
pursuant to the Enabling Act. The governing board consists of
ten (10) members who are elected on a nonpartisan basis by a
vote of the electorate of the county at large. Meetings of the
Board of Directors are open to the public. Notice is given and
minutes are recorded in accordance with Florida's Sunshine Laws.
The health system includes
four acute care hospital locations, Cape Coral Hospital, Lee
Memorial Hospital, HealthPark Medical Center, and Gulf Coast
Medical Center as well as other
healthcare facilities and services, which include a home health
agency, a nursing home, outpatient treatment and diagnostic
centers, physician offices, a children's hospital and a
rehabilitation hospital. Certain of these operations are carried
out through sub-agencies for administrative purposes and are not
incorporated under the corporation laws of Florida. Other system
operations are carried out through subsidiary corporations or
joint ventures.
